Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using https://www.trudoor.com (“the Site”) operated by Trudoor, LLC (“Trudoor”, “Trudoor – Doors & Hardware”, “us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://www.trudoor.com.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.

Acceptance of Contract Terms

The following forms a legal agreement between you and Trudoor, LLC. By using this site you are acknowledging that you have read, understood, and agree to be bound by these terms and all applicable laws and regulations. If you do not agree to these terms please do not use this site. Any claim relating to the use of this site, its materials and any sales thereunder is governed by the laws of the State of Arizona, without regard to conflict of laws and Arizona will be the sole jurisdiction and venue for any litigation arising from the use of or orders made on the site.

Use Restrictions

The copyright in all material provided on this site is held by Trudoor, LLC. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise without the prior written permission of Trudoor. Permission is granted to display, copy or distribute and download the materials on this site for personal, non-commercial use only, provided you do not modify the materials and that you retain all copyright and other proprietary notices contained in the materials. This permission terminates automatically if you breach any of these terms or conditions or upon the request of Trudoor. Upon termination, you must immediately destroy any downloaded and printed materials. You also can not “mirror” any material contained on this site. Any unauthorized use of any material contained on this site may violate copyright laws, trademark laws, and various other regulations and statutes.

Trademarks

The trademarks, service marks, and logos (the “Trademarks”) used and displayed on this site are registered and unregistered Trademarks of Trudoor, LLC, and others. Nothing on this site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on this site without the written permission of the Trademark owner. Trudoor enforces its intellectual property rights to the fullest extent of the law. Trudoor prohibits the use of the Trudoor logo as a “hot” link to the Trudoor site unless establishment of such a link is approved in advance by Trudoor in writing.

Intellectual Property

The Site and its original content, features and functionality are owned by Trudoor, LLC and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. This website claims no credit for any images posted on this site unless otherwise noted, including product photos. Images on this website are copyright to its respectful owners. If there is an image appearing on this website that belongs to you and do not wish for it appear on this site, please email Trudoor, LLC with a link to said image and it will be promptly removed.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer Warranty

THIS WEBSITE AND THE INFORMATION PROVIDED HEREIN ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT POSSIBLE PURSUANT TO THE APPLICABLE LAW, TRUDOOR, LLC DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS. TRUDOOR, LLC DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE, VALIDITY, ACCURACY, OR RELIABILITY OF, OR THE RESULTS OF THE USE OF, OR OTHERWISE RESPECTING, THE MATERIALS OR PRODUCTS ON THIS SITE OR ANY SITES LINKED TO THIS SITE.

Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL TRUDOOR, LLC BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, HARM TO EQUIPMENT AND/OR PERSONAL INJURY OR DEATH, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF TRUDOOR, LLC OR A TRUDOOR, LLC AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Trudoor is not responsible for typos or misprints contained within our Web Site. We reserve the right to correct typos, errors, and descriptions as needed to maintain accurate information. Under no circumstances will Trudoor, LLC be liable for misquoted content. All information and prices should be verified prior to final transactions.

Our Site may contain links to third-party sites that are not owned or controlled by Trudoor, LLC. Trudoor has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Governing Law

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the State of Arizona, United States, without giving effect to any principles of conflicts of law.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access, or continue to access the Site or discontinue any use of the Site immediately.

Payments

Payment is due in full upon placement of all orders to be shipped outside the State of Arizona. At the sole discretion of Trudoor LLC, we may allow a 50% deposit on orders requiring significant or lengthy production, with the remaining balance due prior to shipment.

Arizona Customers

All orders placed at our Phoenix warehouse that are available for immediate pickup or the same day are required to be paid for in full, upon placement of order. Unless granted credit, all orders with estimated lead times exceeding 2 (two) working days require a 50% deposit with the remaining balance due at time of receipt or prior to shipping.

All first-time customers are required to submit at least a 50% deposit prior to the placement of an order, with the full balance due at the time of receipt or prior to shipping.

If a deposit is required and you do not make arrangements to pay your balance after 10 (ten) days and you used a credit card or debit card to submit a deposit, Trudoor LLC will charge your credit/debit card on file, to pay for the remaining balance due. If deposit was submitted via cash or check, you may be asked to complete a Past Due Credit Authorization Form.

Charge Accounts

Credit may be extended at the sole discretion of Trudoor LLC. A Net 30 Charge Account Application and a Past Due Credit Authorization Form must be completed and approved by Trudoor LLC before credit can be extended. Should your account become 45 days past due, Trudoor LLC is authorized to charge your credit card or debit card in the amount of the past due balance.

Payment Options

For your convenience, Trudoor accepts American Express, Discover, MasterCard, PayPal, and Visa for orders shipped outside of Arizona. Payment can be submitted through our secure online payment gateway or by telephone.

Arizona customers: Trudoor accepts all major credit cards, cash, and company checks. Payments and deposits can be submitted at our Phoenix warehouse, through our secure online payment gateway or by telephone.

Company Checks: If paying with a company check, order(s) may be held until check clears with our bank.

Sales Taxes

Taxes are calculated for each shipping address total based on the state to which the item(s) is shipped. We will add all applicable taxes to items shipped to AK, AL, AR, AZ, CA, CO, CT, DC, FL, GA, HI, IA, ID, IL, IN, KS, KY, LA, MA, MD, MI, MN, MO, NC, ND, NE, NJ, NM, NV, NY, OH, OK, PA, SC, TN, TX, UT, VA, VT, WA, WI, and WY. Orders picked up at our Phoenix warehouse are subject to tax. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other location. Customers reselling goods or using the goods provided by Trudoor for an exempt purpose may be exempt from tax. A completed Exemption Resale Certificate must be presented before a sale can be exempt from sales tax or transaction privilege tax. Please email a copy of the tax exemption form to tax@trudoor.com

Lead Times

Most standard or non-custom doors and hardware have a lead time of 5-30 working days. Due to the complexity and many custom options of our products, lead times can vary from one order to the next. An approximate ship date will be provided to you after your order has been confirmed. Scheduled shipping dates are based on best estimates, but are not guaranteed. Trudoor will not accept orders with a penalty or late delivery provision without being advised of such a clause when the order is placed and accepts such conditions in writing.

Shipping Policies

Most national (non-Arizona) door orders and larger hardware orders are shipped LTL Freight “tailgate delivery” or “back of the truck” via a ground freight carrier, direct from the manufacturer(s) or from Trudoor, in Phoenix, AZ. Standard shipping does not include liftgate service, but this service is available for an additional fee if requested. Door and frame orders are palletized and/or crated before shipping. All orders shipped outside of the Phoenix, Arizona metro area are subject to a crate fee charge. Most Arizona orders are shipped and delivered by Trudoor. Smaller orders that do not include doors are shipped via FedEx, UPS and/or USPS. Arizona orders delivered by Trudoor are delivered “Back of Truck, Dock/Tailgate Delivery” (Recipient Responsible for Unloading; Driver Will Not Assist in Unloading).

Changes and Order Cancellations

The following applies to any cancellation of part (or all) of an order, or any change to an order, after receipt by Trudoor.
Order Changes or Cancellations must be reported within 24 Hours. Change orders or cancellations requested after 24 hours are subject to the approval of Trudoor. Additional charges may apply, including restocking fees. Order cancellations on custom, modified or fabricated orders are not accepted and will be charged at the full quoted price, minus shipping expenses. Trudoor reserves the right to reject any change order request submitted after 24 hours.

Returns

Trudoor does not allow returns for any material sold & received as ordered, unless authorized. A restocking charge may be invoked in connection with the return of any product. We do not, by any means accept returns for custom, modified, prepped, pre-finished, or previously installed products that have been altered whatsoever from their original condition. For information regarding freight damage, defective products, warranties or order discrepancies, see below.

Products eligible for return may be accepted for return within 60 days of purchase. We cannot accept returns for products purchased more than 60 days ago. If defective after 60 days, please refer to our warranty policies.

Freight Damages

All shipments not delivered by a Trudoor owned truck are F.O.B. Point of shipment. Title passes at the time of shipment. All freight claims are the responsibility of the purchaser. Customer must note any freight damage on the receiving tickets or bill of lading and shall be responsible for filing claims with the delivery carrier. Trudoor LLC shall not be responsible but will provide assistance in making such a claim. Visibly damaged goods must be reported to the driver, noted on the bill of lading and must be reported to support@trudoor.com within 48 hours of delivery. If the package shows visible damage and you feel that all or most of the material is unusable, we recommend that you refuse the delivery in its entirety.
NOTE: Surface scratches on metal doors and frames do not constitute damage, as doors are shipped unfinished (primed gray).

Defective Products & Warranties

Trudoor warranties all products under the original manufacturer warranty. To report a defective product or warranty claim, contact us.

Missing or Wrong Items:

Missing or wrong items must be reported within 24 hours of receiving material. To report missing or wrong items, contact us.
